Woman sues over wedding picture on greeting card

DAYTON, Ohio (AP) -- A woman pictured on a greeting card drinking whiskey and smoking a cigarette in her wedding dress has filed a lawsuit demanding that the card be pulled from store shelves.
The photo of Michele Hemphill was taken 22 years ago while she was with her bridesmaids before her wedding. It is featured on a greeting card with the caption: "Intoxicating Love." Inside it says, "Isn't love intoxicating? Congratulations on your special day."
Hemphill, a mother of three who works at an assisted living community and is active in her Springfield church, seeks damages of more than $25,000 for invasion of privacy, publication of private matters, intrusion upon seclusion and slander in her lawsuit filed in U.S. District Court.
She asks that all copies of the photograph be destroyed and for the card to be removed from retailers.
Named as defendants are Wallace McNamee of Hilton Head, S.C., who took the photo; Corbis Corp. of Olympia, Wash., an online digital image company; and Portal Publications Ltd. of Novato, Calif., a greeting card publisher.
Defense attorney David Shough said his clients did not want to comment.
McNamee was on assignment for Newsweek doing a story about families in the Springfield area when he took the picture, which Hemphill never authorized to be used on greeting cards, the lawsuit says.
McNamee licensed the photograph to Corbis, which licensed it to Portal in January 2003 for "nonexclusive use on greeting cards and postcards for worldwide distribution for a three-year period," the lawsuit says.
Hemphill learned of the card on July 31, 2003, when a friend received it. The card is available at retailers in the Dayton and Springfield areas, the lawsuit says.
Hemphill's attorney, Richard Schulte, said Portal has removed the picture from its Web site, but not from store shelves.

In case you've been hibernating far from drugstores and restaurants, tomorrow is Valentine's Day. Some people have been planning this special day for weeks. They ordered the perfect flowers, picked the perfect place for dinner and made perfect reservations. · Then there are the rest of us. · It might be too late to get a prime table at one of the hottest restaurants in town, but take heart: You can still pull off a romantic evening -- flowers, dinner with a nice bottle of wine, a nightcap at a hot lounge. Let the experts tell you how it's done.

Option No. 1 for last-minute flowers: You could pick up some day-old, slightly-too-open roses from a guy outside a Metro station. But that's the dead giveaway that you forgot to buy flowers in advance and might not win you any points with your date.
So let's move on to options No. 2 and 3, okay, Romeo?
Florist Allan Woods, who opened his eponymous store in Woodley Park in 1976, says that about 50 percent of his customers wait until Valentine's Day to purchase flowers. At your better florists, it's generally not a case of having to grab the last bunch of roses in the cooler. Most flower shops ordered extra stock months ago. "We seldom sell out of flowers [on Valentine's Day]," Woods says.

These are my ideas, I gave these to my husband for 3 different Valentines Days in past...
1) I found old games at garage sales (bought at next to nothing prices) and saved only the game pieces and cards (Monopoly was a score) I used the Monopoly "chance" cards - wrapped in red and listed for my hubby how he could exchange the card for, get out of an argument free, forgetfulness free card, I'm sorry card, etc. along with a handmade Valentine's card to him saying how I was glad I was married to him.
2) One year I made and laminated 2 ea. (2" x 3") cards printed with FREE PASS anytime, anywhere --were in small fine print and added this to my blonde brownies in heart basket. He has a pass to anywhere anytime (one was in case he lost one of them.) He really liked that card!
3) I found a small red mail box, addressed it to him with the flag up, and made up my own coupons (free manicure, free facial, free foot rub, free I'm Sorry, free day with the guys, free wash and wax, free 'I don't want to have to go to ________, free to do what I want to do day,etc. He used them all up for his special occasions! And I got the benefits of all those coupons too, because I love doting on him!
You can be creative and cost-conscious at the same time.
